Niklaus AI — Terms & Conditions

Niklaus AI is a Personal AI Academic Tutor and academic learning-support platform.

The Service is designed to help users understand academic tasks and assignment briefs, identify requirements, interpret assessment expectations, explore appropriate academic approaches, identify and understand research sources, develop structures and plans, improve writing clarity, and view educational academic examples.

A registered user's work is organised into Projects and Assignments. Within an Assignment, Niklaus may provide Explain My Brief, Ask Niklaus tutoring, Paraphrase, Grammar & Clarity, Presentation Support, Charts & Tables, and Study Plan/Gantt tools, depending on what the user has uploaded and what they ask for.

Niklaus may also analyse an assignment brief supplied by the user and generate an Academic Learning Example based on information contained in that brief and any additional instructions provided.

An Academic Learning Example is educational reference material intended to demonstrate how academic requirements, research, structure, argument, referencing and academic writing techniques may be approached.

Niklaus AI is not a university, educational institution, examination body, accreditation provider, teacher, lecturer or official representative of the user's institution.

Academic Learning Examples are provided for learning, study, reference and educational guidance.

They may be customised according to an assignment brief, academic level, topic, organisation, product, market, methodology, framework or other requirements supplied by the user.

Their purpose is to help the user understand how an academic task may be approached.

An Academic Learning Example is not represented by Niklaus AI as the student's own assessed work and is not intended to be submitted as such.

Where supplied in DOCX format, Academic Learning Examples may contain an academic-integrity notice identifying the document as an educational example and not as submission-ready assessed work.

The presence or absence of such a notice does not change the user's obligations under these Terms.

Users remain responsible for producing any assessed work their school, college, university, training provider or awarding organisation requires them to complete personally.

Users must follow the academic-integrity rules, assessment regulations and AI-use policies of their institution.

Different institutions and assessments may permit different levels of AI assistance.

Unless expressly permitted by the relevant institution and subject to any required disclosure or attribution rules, users must not:

• submit an Academic Learning Example, in whole or in part, as though it were their own original assessed work
• misrepresent Niklaus-generated material as personally created work
• use Niklaus to impersonate another person or misrepresent authorship
• use Niklaus to circumvent academic-integrity controls
• knowingly use Niklaus in a way expressly prohibited for the relevant assessment

Niklaus may provide explanations, planning support, research guidance, examples, models and feedback. The user remains responsible for turning that learning into their own academic work.

Niklaus also provides editing tools — Paraphrase and Grammar & Clarity — that work on a student's own uploaded academic work rather than generating a new example from a brief.

Output from these tools is a modified version of the user's own submitted text. It is not treated as, and is not presented as, an Academic Learning Example, and does not carry the academic-integrity notice described in section 2.

Using an editing tool does not change the user's responsibility for their own final submission. Users remain responsible for checking that the resulting text reflects their own understanding, expressed in their own words, and for following their institution's rules on permitted editing and AI assistance.

Users may upload assignment briefs or other academic instructions so Niklaus can explain the requirements and provide relevant educational guidance.

Niklaus may identify required deliverables, academic level, frameworks, methodologies, word limits, marking expectations, referencing requirements, organisations, products, countries, industries and other relevant requirements.

Academic Learning Examples may include Niklaus Tutor Notes explaining what a section of the brief requires, what the requirement means and what the student should learn from the example.

If Niklaus's interpretation differs from the official assignment brief, the official brief and institution instructions take priority.

Within an Assignment, a user can ask Niklaus questions and receive tutoring support through Ask Niklaus, an ongoing conversation scoped to that Assignment.

Niklaus may also provide Charts & Tables and Study Plan/Gantt tools that generate supporting material — such as a data chart, a table, or a project timeline — based on an Assignment's brief or the user's own uploaded work.

Ask Niklaus replies, charts, tables and Study Plans are educational and organisational support material. Where a reply includes a worked example rather than general guidance, it may be presented and exported in the same way as an Academic Learning Example, in which case section 2 applies to that specific content.

These tools do not replace the user's own understanding of their assignment, and users remain responsible for verifying and applying the guidance given.

Niklaus uses artificial intelligence and automated systems.

AI-generated material may contain errors, omissions, incorrect interpretations, outdated information, inaccurate citations or apparently plausible but incorrect information.

Users must independently verify important information.

In particular, users should verify academic sources, authors, publication dates, quotations, statistics, URLs, DOIs, legislation, company information, references and bibliographic information.

Automated review processes do not guarantee that information is correct.

Niklaus does not guarantee:

• a particular grade or mark
• acceptance by a lecturer or institution
• compliance with every institutional AI policy
• plagiarism-detector results
• AI-detector results
• acceptance of sources
• any particular academic outcome

Academic decisions remain with the relevant educational institution or awarding body.

Users are responsible for maintaining control of their Niklaus account and credentials.

Niklaus may allow accounts to operate using a private username without requiring a university student number or real name.

This privacy design does not permit misuse of the Service or avoidance of academic obligations.

Accounts may be restricted or suspended where there is reasonable evidence of fraud, abuse, security compromise or material breach of these Terms.

Users must have legal capacity to enter into these Terms.

Users under 18 may use Niklaus only where legally permitted or where required parental or guardian consent has been obtained.

Particular paid services may be restricted to users aged 18 or over.

Users must have the right to upload any document, text, image or other material supplied to Niklaus.

Users must not knowingly upload unlawfully obtained material, confidential examination material they are not permitted to use, copyrighted material they have no right to provide, or another person's personal information without an appropriate lawful basis.

Users retain whatever rights they already hold in material they upload.

This includes an assignment brief and a user's own existing academic work uploaded to a Project or Assignment. Uploaded material, and the files Niklaus generates from it, are stored so a user can access them again within their workspace until deleted — see section 26 and the Privacy Policy for how that works.

Users grant Niklaus a limited licence to process, transmit, copy and store uploaded material where necessary to provide the Service.

Niklaus may use third-party technology providers for AI models, hosting, payments, document processing, research tools and other necessary services.

Information supplied to Niklaus may therefore be processed by relevant providers where necessary to deliver a requested feature.

Such providers are not the user's educational institution and do not determine whether a particular academic use is permitted.

Niklaus may provide Presentation Support, including assistance creating presentation structures and PPTX documents.

Presentation Support is available both after generating an Academic Learning Example and directly from a user's own uploaded academic work within an Assignment.

Presentation Support is intended to help users communicate academic information effectively.

Generated presentations remain subject to the same accuracy, academic-integrity and institutional-policy responsibilities described in these Terms.

KLAUS is Niklaus's internal platform credit system.

KLAUS is not money, electronic money, cryptocurrency, a financial asset or an investment.

KLAUS has no cash value outside Niklaus and cannot normally be transferred between users or redeemed for cash except where required by law.

The number of KLAUS required for a feature may depend on generated word count, document type or selected service.

Purchased and promotional KLAUS may have different conditions where clearly disclosed.

Niklaus may temporarily reserve KLAUS when a generation begins.

A reservation is not necessarily a final charge.

Where charging occurs after preparation of an Academic Learning Example, the relevant KLAUS are charged when the applicable completion condition is reached.

If generation fails, stalls or is abandoned in circumstances recognised by the Service, reserved KLAUS may be returned to the user's available balance.

Mandatory Niklaus academic-integrity notices and document footers are not part of billable academic content.

Billing History provides a record of KLAUS transactions associated with the account.

Prices are displayed before purchase.

Niklaus may offer KLAUS packages, one-time plans, trials and promotional access.

The price, KLAUS allocation, document limit, presentation entitlement and features displayed at checkout form part of the relevant purchase.

Prices and packages may change prospectively.

Completed purchases will not be retrospectively changed except where permitted by law.

Payments may be processed by third-party payment providers.

Niklaus may offer free trials, Founding User access, complimentary KLAUS or other promotions.

Eligibility, word limits, slide limits and availability may apply.

Promotions may be limited by account, user, time period or number of available places.

Attempts to create multiple accounts to circumvent promotional limits may result in promotional access being withdrawn.

Nothing in these Terms removes consumer rights that cannot legally be excluded.

Consumers may have statutory cancellation rights for certain distance contracts.

Where digital content or services begin immediately, Niklaus may request express consent for immediate supply and any acknowledgement required by applicable consumer law.

Where applicable law provides a right to refund, repair, repeat performance, price reduction or another remedy, these Terms do not remove that right.

Users requiring assistance should use the support options made available through Niklaus AI.

Where KLAUS are reserved for a generation that does not successfully reach the chargeable completion stage, the Service may automatically release those reserved KLAUS.

If an incorrect charge occurs because of a technical failure, users may use the support options made available through Niklaus AI so the transaction can be investigated.

Any contractual refund policy operates in addition to statutory consumer rights.

Users must not use Niklaus to:

• break the law
• commit fraud
• infringe intellectual-property rights
• distribute malware
• attack or interfere with Niklaus
• obtain unauthorised system access
• manipulate billing systems
• abuse automation
• resell the Service without permission
• intentionally facilitate academic misconduct

Niklaus may apply reasonable technical limits to protect users and the Service.

Niklaus AI, its software, branding, interface, design, templates, workflow, documentation, logos and underlying technology are owned by or licensed to the operator of Niklaus AI.

Subject to these Terms and applicable third-party rights, users may use Academic Learning Examples generated for their account for personal educational and study purposes.

Niklaus does not guarantee that copyright or other intellectual-property rights arise in any particular AI-generated output.

No ownership of third-party sources or material referenced by Niklaus is transferred to the user.

Niklaus aims to remain available and reliable but uninterrupted availability cannot be guaranteed.

The Service may occasionally be unavailable due to maintenance, technical failures, third-party outages, upgrades, security incidents or circumstances outside reasonable control.

Features may evolve over time.

Niklaus may change AI providers, models, research tools, document-generation systems and technical components.

Results may vary over time even when similar instructions are provided.

These changes do not alter the user's responsibility to verify generated material.

Niklaus may suspend or terminate access where reasonably necessary because of serious or repeated breach of these Terms, fraud, payment abuse, security risk, unlawful conduct or misuse of the Service.

Where appropriate, Niklaus may explain the reason for the restriction.

Mandatory consumer rights relating to paid services remain unaffected.

Niklaus will provide the Service with reasonable care and skill and in accordance with applicable consumer law.

Niklaus is responsible for foreseeable loss or damage caused by breach of these Terms or failure to use reasonable care and skill.

Niklaus is not responsible for academic consequences resulting from a user's failure to follow institutional rules, misuse of generated material contrary to these Terms or failure to reasonably verify generated information.

Nothing in these Terms limits liability where doing so would be unlawful.

A user can delete a Project or an Assignment at any time. Deleting either does not remove it immediately — it moves to Trash and can be restored for 30 days, after which it is scheduled for permanent removal from Niklaus's systems.

Deleting an Assignment does not delete the Project it belongs to. Deleting a Project also moves its Assignments to Trash with it.

Financial, billing and security records are not affected by deleting a Project or an Assignment.

Deleting an entire Niklaus account is not yet available as a self-service action. A user may request account deletion using the support options made available through Niklaus AI.

Use of Niklaus is also subject to the Niklaus Privacy Policy.

The Privacy Policy governs the handling of personal information and should be read together with these Terms.

Niklaus may update these Terms where reasonably necessary due to changes to the Service, law, regulation, security requirements or business operations.

Material changes may be communicated through the Service.

Changes will not retrospectively remove mandatory consumer rights.

Users experiencing a problem with Niklaus may use the support options made available through the Service.

Users should provide sufficient information to identify the relevant account, service or transaction without supplying passwords or unnecessary sensitive information.

Statutory rights to pursue remedies remain unaffected.

These Terms are governed by the laws of England and Wales.

Consumers resident elsewhere retain any mandatory consumer protections applicable in their country of residence where those protections cannot legally be excluded.

These Terms, together with the Privacy Policy and any specific purchase or promotional terms displayed by Niklaus, form the agreement governing use of the Service.

If any provision is found invalid or unenforceable, the remaining provisions continue to apply.

Failure to enforce a provision immediately does not waive the right to enforce it later.
